1. Introduction & Acceptance
- These Terms of Service (“Terms”) govern your use of theanthara.com and your purchase of products or services (“Services”).
- By accessing or using this Website or placing an order, you agree to be bound by these Terms and related policies.
- If you disagree with any part, please do not use the Website or Services.
2. Modifications
- We may amend or update these Terms at any time without prior notice.
- Continued use of the Website or Services after changes implies acceptance of the updated Terms.
3. Eligibility & Account Security
- You must be of legal age (or have guardian consent) to enter into binding contracts.
- You agree not to use the Website for unlawful or unauthorized purposes.
- If you create an account, you are responsible for maintaining confidentiality of your credentials and for notifying us immediately of any unauthorized use.
4. Product Listings, Accuracy & Availability
- We aim to provide accurate descriptions, images, and pricing, though slight variations may occur.
- Prices, availability, and specifications may change without prior notice.
- If a product becomes unavailable after ordering, you will be notified and refunded in full.
5. Order Placement, Acknowledgment & Acceptance
- Placing an order constitutes a request to purchase.
- You will receive acknowledgment upon order placement and confirmation once dispatched.
- We reserve the right to cancel or refuse orders in case of errors, fraud suspicion, or unavailability.
- Title and risk transfer to you once the product leaves our facility.
6. Delivery & Time Slots
- Preferred delivery time slots are treated as requests, not guarantees.
- We will make every effort to honor your chosen slot, but delays may occur due to traffic or other factors.
- Inspect perishable goods upon delivery; report any damage within 4 hours for cakes or 6–8 hours for couriered items.
- Only one delivery attempt will be made unless otherwise agreed.
7. Cancellation Policy
- Cancellations requested more than 24 hours before the delivery slot may incur a 10% fee.
- Between 12 to 24 hours before delivery, a 20% fee may apply.
- Within 12 hours of the slot, cancellations are non-refundable.
- Same-day or special orders may not be cancellable.
8. Refund Policy
- Refunds for eligible cancellations or our failed deliveries will be processed once refund mode is confirmed.
- Bank or payment method refunds typically take up to 15 working days.
- No refunds for failed deliveries due to customer-related issues such as wrong address or recipient unavailability.
9. Address Change / Rescheduling
- Requests to change address or reschedule must be made at least 24 hours before delivery.
- Late changes may incur a ₹200 fee or may be declined.
- If address change isn’t possible after cutoff, the order may be cancelled without refund.
10. Non-Delivery / Execution Completed
- Orders are considered completed (“executed”) when any of the following apply:
- Wrong shipping address provided by customer.
- Premises locked or inaccessible.
- Recipient unavailable or refuses delivery.
- Delivery completed as per instructions (gate/neighbour).
- Incorrect contact number provided.
11. Use of Content & Submissions
- You retain ownership of your content (reviews, images) but grant Anthara a license to use it for marketing and promotional purposes.
- Your submissions must not violate third-party rights or contain unlawful or defamatory material.
12. Third-Party Links & Tools
- Our Website may contain third-party links or integrations (e.g., payment gateways).
- We are not responsible for their functionality, policies, or actions.
- Use of such third-party services is at your own risk.
13. Warranty Disclaimers & Limitation of Liability
- All services and products are provided “as is” without warranties of any kind.
- We do not guarantee uninterrupted or error-free operation of the Website.
- Our total liability shall not exceed the amount paid by you for the affected product or service.
14. Indemnification
- You agree to indemnify and hold harmless Anthara, its employees, and representatives from claims or losses arising from your misuse of the Website or breach of these Terms.
15. Termination
- We may suspend or terminate access to the Website if you violate these Terms.
- Upon termination, your right to use the Website ceases, but prior obligations remain valid.
16. Governing Law & Dispute Resolution
- These Terms are governed by the laws of India.
- Disputes shall be subject to the exclusive jurisdiction of courts in the applicable city or state.
17. Severability & Entire Agreement
- If any clause is found invalid or unenforceable, the remainder of the Terms will remain in effect.
- These Terms, along with the Privacy and Refund Policies, constitute the entire agreement between you and Anthara.
